Terms and Conditions

The following terms and conditions listed below will apply between yourself and Art Mash for the sale and purchase of items or experiences contained in your basket or purchased via email, phone or in person. The terms do not affect your statutory rights.

Note: ’experiences’ refers to class, course, workshop or any activity organised by Art Mash

GENERAL

To ensure the safety of our customers and team we are committed to being responsive and vigilant. We will regularly monitor advice from Public Health England and the UK government and take the necessary action to help us all stay safe.

You must comply with all rules and regulations issued by us and please pay particular attention to any requirements as to dress or the wearing of protective equipment.

Disruptive, abusive, or inappropriate behaviour, language or threatening behaviour towards team or other customers will result in you being asked to leave the studio. Any payments already made to Art Mash will not be reimbursed in this event

BOOKINGS AND PAYMENT

Bookings are subject to full payment as set out on the Art Mash website.

Payment is via invoice, paypal or one of our online suppliers such as Etsy. All card payments made over the telephone are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, your order will not be accepted, and Art Mash will not be liable for any delay or non-delivery.

EXPERIENCES

The terms of Art Mash’s price list and these terms and conditions constitute the terms of the legally binding contract between you, the customer, and Art Mash.

Bookings are for a specific start, finish, and time duration. If you do not attend on a punctual basis, we cannot guarantee that you will receive your full experience.

We do not offer provisional bookings; all bookings must be confirmed by payment otherwise we cannot guarantee that your booking will go ahead. If your date of choice is fully booked, you will be offered the next available date.

CANCELLATIONS

Our cancellation policy is designed to give customers the freedom to amend a booking without penalty when enough notice is given, but we have some conditions around short notice cancellations which have an impact on other customers and our business. We will always try to help where possible within the limits of our business. Please read our terms of cancellation carefully.

Note: We strongly advise that customers have a suitable travel/activity insurance policy in place that can provide cover for common issues such as ill health (including COVID-19) or travel disruption.

TERMS OF CANCELLATION

All cancellation requests must be sent in writing by email to Lisa@artmash.co.uk. If you have not received an email confirmation within 5 working days, please contact us on 01271 817587 or 07540 468808 . Unless you have received a written acknowledgement from us that we have received your request, you cannot consider your booking cancelled.

Note: all cancellation terms apply to bookings made when redeeming an Art Mash gift voucher.

BOOKING CANCELLATIONS MORE THAN 21 DAYS BEFORE BOOKED ACTIVITY

You may request a change of dates up to 21 days prior to your booking and we will happily transfer your experience to another date subject to availability without cost.

You may request a refund up to 21 days before your experience.

BOOKING CANCELLATIONS WITHIN 21 DAYS OF BOOKED ACTIVITY

Cancellations received within 21 days of the course start date – payments are non-refundable.

You can transfer/sell the booking to another person free of charge if you notify us.

If a person who is booked in for an experience fails to attend for any reason, they will not be entitled to a refund or a re-booking.

We may, in our sole and absolute discretion, vary our cancellation policy and we may ask for documentary evidence to make this decision. Any refunds awarded at this stage will be subject to an administration fee.

VOUCHERS

Vouchers are valid for a period of 12 months from the date of purchase and cannot be redeemed after the expiry date.

E-vouchers are provided free of charge to the email address provided at point of purchase. Experiences must be booked in advance. Booking contact details are provided on the voucher.

Vouchers are non-refundable other than within the 14-day cancellation period as per the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. No change or credit will be given should the voucher value exceed the total cost of the experience – for example where a £100 voucher is used to purchase a £95 experience. Vouchers cannot be exchanged for cash. Lost, stolen, or destroyed gift vouchers will not be exchanged or refunded.

Vouchers can be used for part or full payment of any experience or to purchase products from Art Mash. If the cost exceeds the amount of the gift voucher, the balance must be paid in full at the point of booking.

Bookings made using vouchers are subject to the cancellation policy above. However, vouchers must be redeemed within the expiry date stated.

CANCELLATIONS BY ART MASH

Art Mash will be entitled to cancel any booking at any time subject to the repayment of any deposit or fees received for the booking that has been cancelled.

In the unlikely event of cancellation of a booking by ourselves for reasons not defined in Force Majeure, we undertake to offer a suitable transfer to an alternative date, or a full refund (within 7 days) of the cost of the booking. We cannot be held liable for any third-party costs, such as travel bookings or accommodation.

FORCE MAJEURE

If Art Mash is forced to close due to circumstances outside our control (including but not limited to a pandemic, epidemic, or adverse weather conditions), customers will be offered a voucher to the value of the booking that had to be cancelled. This will be valid for 12 months from the date that original experience was due to take place.

It is essential to book in advance for any future experiences.

AVAILABILITY OF EXPERIENCES AND PRICES

Products will be sent to the address given by you in your order stated in the Order Confirmation.

We make every attempt to ensure that all prices on our website are accurate, however, discrepancies may occur. If we discover an error in the price of experiences or products already ordered we will inform you as soon as possible and ask that you reconfirm your order at the correct price, while also giving you the option to cancel it. If we are unsuccessful in contacting you, we will consider the order cancelled.

INTERNATIONAL SHIPPING

If your delivery address is not in the United Kingdom, you may be subject to import duties and taxes, which are levied once a shipment reaches your country. Any such additional charges for customs clearance must be borne by you. You should note that customs policies vary widely from country to country; so Art Mash advises each customer to contact their local customs office for further information.

You should be aware that cross-border shipments can be subject to opening and inspection by customs authorities.

The terms and conditions are subject to change at any time, and it is your responsibility to check these terms and conditions before placing an order or prior to requesting a cancellation in case there are any changes.

If, for any reason, your order cannot be processed, a member of the Art Mash team will contact you to explain the nature of the difficulty.

OUR CONTRACT

No contract for the sale of any experience will subsist between you and Art Mash until a confirmation has been sent. You must check that the details on this confirmatory e-mail are correct as soon as possible and we recommend that you keep this for your records.

DAMAGED PRODUCTS OR INCORRECT DELIVERIES

All artwork must be stored in appropriate conditions; if you do not store them in appropriate conditions, we cannot be held responsible for faults or problems that arise as a result. We do not recommend cleaning handmade or hand painted items in a dishwasher. Any claim by you in respect of any damaged or incorrect deliveries, must be notified to us as soon as possible. In some cases, Art Mash may require you to return incorrect deliveries for which we will pay postage and ensure the delivery of correct items but will have no further liability to you.

If you do not notify Art Mash accordingly, Art Mash shall have no liability for any damage or incorrect deliveries.

Art Mash shall have no liability to the customer for any failure to deliver artwork or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control.
